That blows, I'm sorry to hear that :( I hate that feeling of being dismissed too! To be honest my situation hasn't gotten worked out all the way either it turns out, but there's always hope! Hope that companies play by the rules (and the LAW!) and that they make good. I'm no lawyer, but I've been told we always have the option to sue if need be. Which really sucks when it comes down to it.

If I could help you, I would!!! I know this makes you not want to invest later, but 99% of the companies out there actually DO follow the law ;) Maybe you can invest in your own stuff outside of 401ks when you're ready again? Just to get your feet wet? Roth IRAs are usually a good place to start depending on your salary and some other things.

Either way, GOOD LUCK!

I am glad your 401k problem worked out for you. I still have several thousand dollars missing. No amount of talking to the CEO has helped. HR doesn't answer the phone and does not return emails or voicemail messages. My money has been "hanging out" there for over 9 months now. There is only one explanation: the company kept it for their own cash flow. Others at my previous place of work (I had it with them and left) are also in this position. I turned my company into the Department of Labor in October 2009 - still no luck. That department moves slower than malasses in January! I put $3000 in there and my account at Prudential remains zero. I have been in contact with Prudential and they say no money has arrived - my account remains zero, as it has, since the first day I was hired. This has soured my desire to ever want to contribute to a 401k again. In my mind, it is nothing but a voluntary "contribution plan" to fund the lifestyles of senior management.
